1. Scope and provider
1.1 These terms and conditions ("Terms") apply to the use of the website https://eatzino.com and the Eatzino apps (together the "Platform") by customers ("you").
1.2 The Platform is operated by Aximatix Private Limited, Connaught Place, New Delhi 110001, India ("Eatzino", "we"). Further details are in our Imprint.
1.3 Any differing terms of customers do not apply.
2. Our role
2.1 Through the Platform, Eatzino arranges orders for food and drinks from participating, legally independent restaurants and shops ("Restaurants").
2.2 The purchase contract for the food and drinks ordered is concluded solely between you and the respective Restaurant. The Restaurant is responsible for preparing its products, their quality and the information about them (including prices, ingredients and allergens).
2.3 Eatzino accepts payments in the name and on behalf of the Restaurant. Payment to Eatzino discharges your payment obligation towards the Restaurant.
3. Customer account
3.1 You need a customer account to place orders. You must be at least 16 years old and provide truthful information.
3.2 Keep your login details secret and tell us immediately if you suspect misuse.
3.3 You can delete your account at any time in your profile settings. We may suspend accounts for serious or repeated breaches of these Terms.
4. Ordering and conclusion of contract
4.1 The food and drinks shown on the Platform are not a legally binding offer but an invitation to order.
4.2 You can add products to your cart, choose a delivery address, time and payment method, and check and correct your details before submitting. By clicking the order button you make a binding offer to the Restaurant.
4.3 The contract is concluded as soon as the Restaurant accepts the order. We notify you of acceptance in the app, by email or by push notification. If the Restaurant does not accept the order, any amount already paid is refunded in full.
4.4 The contract languages are German and English. You can view your order details in the order history of your account.
5. Prices, fees and minimum order
5.1 All prices are final prices in euros including statutory VAT.
5.2 A delivery fee, a service fee and – if the order is below a minimum order value – a surcharge may also apply. All fees are shown to you before you complete your order.
5.3 We pass on any voluntary tip for the courier in full.
6. Payment
6.1 The payment methods shown at checkout are available (e.g. card, PayPal, cash on delivery, Eatzino wallet balance).
6.2 For online payment, the amount is charged or authorised when you complete the order. For cash payment, you pay the courier on handover or at pick-up.
7. Delivery and pick-up
7.1 Delivery times shown are estimates. Delays, e.g. due to traffic or weather, are possible.
7.2 Please make sure you can be reached at the address and phone number you provide. If handover is not possible for reasons for which you are responsible, the payment claim remains.
7.3 Alcoholic drinks and other age-restricted products are only handed over to people of the legal minimum age. The courier may ask for ID; if none is shown, these products will not be handed over.
7.4 For pick-up orders, collect your order from the Restaurant at the time shown.
8. Cancellation
8.1 As long as the Restaurant has not yet accepted your order, you can cancel it free of charge in the app.
8.2 After acceptance, cancellation is only possible by agreement with the Restaurant, because preparation usually starts immediately.
9. No right of withdrawal for food and drinks
There is no right of withdrawal for contracts for the supply of goods that can spoil quickly or are prepared to your specifications (§ 312g(2) nos. 1 and 2 BGB), or for food and drinks delivered on frequent and regular rounds (§ 312(2) no. 8 BGB). This applies in particular to freshly prepared meals. For sealed goods that are not suitable for return for health or hygiene reasons, any right of withdrawal expires once the seal has been removed (§ 312g(2) no. 3 BGB).
10. Complaints and refunds
10.1 If something is missing, wrong or defective, please report it if possible within 24 hours of delivery using the "Refund" option in your order history or by contacting info@eatzino.com – ideally with a photo.
10.2 We review your report together with the Restaurant. If it is justified, we refund the amount concerned (including the delivery fee where applicable) to your original payment method or – if you agree – as Eatzino wallet balance. Refunds to card or PayPal may take a few business days depending on the provider.
10.3 Your statutory warranty rights remain unaffected.
11. Wallet balance, vouchers and promo codes
11.1 Eatzino wallet balance can only be used for orders on the Platform and is not paid out unless the law requires otherwise.
11.2 Promo codes are valid only under the conditions stated, cannot be combined unless stated otherwise, and cannot be exchanged for cash. The Referral Programme Terms apply to the referral programme.
12. Reviews and content
Reviews must be based on an actual order, be truthful and must not contain offensive, unlawful or promotional content. We may remove reviews that break these rules.
13. Allergens and additives
Information on allergens and additives comes from the Restaurants. If you have an allergy or intolerance, please contact the Restaurant before ordering.
14. Liability
14.1 We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
14.2 For slight negligence, we are liable only for breach of an essential contractual obligation (one whose fulfilment makes proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for the contract.
14.3 The respective Restaurant is responsible for the preparation and condition of food and drinks.
15. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have a problem, please contact info@eatzino.com.
16. Changes to these Terms
We may change these Terms with effect for the future where there is an objective reason (e.g. new features or changes in the law). Each order is governed by the version in force when the order is placed.
17. Governing law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of the country where you habitually reside remain unaffected.
18. Severability
If any provision of these Terms is invalid, the validity of the remaining provisions is not affected.
In case of any discrepancy, the German version of these Terms prevails.
